CHAPTER 1: The Accident:

Be Safe: The first thing to do after an accident is make sure you and everyone in your car is safe and out of traffic. 

Call 911: You should then call 911 right away and report the accident to the police. 

Take Photos: If you are able to take photos of the vehicles and the accident scene, it is best to do so. 

Take Notes: if you or anyone with you has the ability to take notes, do so.  This includes writing down license plates of other cars that may contain witnesses.

Care for Injuries:  If someone is noticeably injured, the police will call an ambulance.  If you have been injured in any way, even if it is just soreness, report it to the police and the emergency personnel that arrive. Report all injuries and get care immediately.  

CHAPTER 2: Investigation:

After the accident, the insurance companies will immediately go to work to limit their losses. Knowing how to deal with them before they contact you is important.

Dealing with Insurance Companies; Do Not Give a Recorded Statement:  Just after the accident is a very vulnerable time. We suggest you do NOT sign a written statement or allow any insurance company to record you while an adjuster asks you questions about the accident.  This is because the statement they take from you will be used to their benefit and not yours.  Likewise, we do not suggest that you accept any money initially offered by the insurance company immediately after your accident.  It is our experience and opinion that these offers are to make your injury claim go away quickly and cheaply. It is okay to tell the insurance you will not allow them to record you.  Instead, we suggest you tell them you need to speak to an attorney first.

What if The Other Driver Lies About the Accident? Sometimes after an accident, people lie when the police come.  It would be nice to think everyone tells the truth but that is not always the case.  Sometimes you will be blamed for an accident that was not your fault.  Sometimes more than one person is lying about the accident and you feel that you have everyone against you, including the insurance company for the other party and maybe even your own insurance company.  This is also the right time to call us for a free consult. 

Is it Really Best to Call an Attorney Right Away?  Yes.  This is the best thing you can do because you will get specific advice related to you specific accident. Sometimes it is not you who has been hurt but a child or another loved one.  Perhaps a person close to you has been killed in an accident.  You may feel that it is inappropriate to call a lawyer during the grieving process or period when you should be focused on the care for your injured loved one.  This is also the right time to call for a free consult.   

I am Not Sure if I am Hurt; What Should I Do? If you have any question whether you are injured or not, you should seek medical attention right away.  This includes getting an ambulance ride to the emergency room or calling your primary care physician's office right away to set up a visit.  This is the only way you will no for sure if you are injured and it is best to err on the side of caution.

What About My Car? The insurance company for the responsible party will pay on the property damage claim. While you wait for this claim to be resolved, you will likely have to rent a car.  Many automobile liability insurance policies will either pay for a rent-a-car up front.  Others will reimburse you for the cost if you.  If we represent you in your personal injury claim, we will assist you in any problems you are having recovering value for your vehicle.

The Free Consult: The purpose of the free consult is to offer you information that you do not have and have no way to get from a trusted source.  Contrary to what it may tell you or make you feel, the insurance company for the responsible person is not on your side.  Sometimes your own insurance company can be difficult.  We are on your side. 

During that free consult we will fully analyze your claim and offer you advice.  If your case is a car accident case, we will retrieve a police accident report at our cost to determine how the police view the case.  If witnesses are listed, we may contact them.  We will discuss your injuries, your treatment thus far and what the doctors may have told you and what that means.  We will offer you very simple advice for the sole purpose of helping you and we will do it for free.    

If we think you need a lawyer, we will offer to represent you. Even if we do not offer our representation to you, we will still give you free practical common-sense advice on how to protect yourself and proceed.

Representation:

Once we take you on as a client, our lawyers and staff do all the work for you regarding your case.  That means, we gather all your medical records and bills.  We instruct you on where the sources of money are for the payment of your medical bills while your claim is unresolved.  Many people think the insurance company (for the person-at-fault) pays the medical bills as they (the injured person) recover.  This is not true and often upsetting to people.  The insurance company for the person at-fault will make one and only one payment to settle your claim.  That is why it is unwise to settle the claim until you have fully recovered from your injuries or have been told by your doctor that you are at a point where you will not get any better (maximum medical improvement).  This can be a predicament and we offer advice and solutions on sources of payment for treatment until the time is right to accept a fair amount from the insurance company. 

CHAPTER 5: Settlement or Litigation:

Once we have gathered all the information necessary to make a demand, we do so in a formal written package that includes photographs, investigation records, medical records and bills, lost wage information and a complete narrative of the pain, suffering and loss of enjoyment of life you have suffered because of another's fault.  We take an interactive approach to this, that involves your final review before submission.  We craft these demand packages in a way that coincides with how the insurance company will assign value.  After submission, the insurance company will generally contact us within 30 days with an offer of settlement.  This initial offer is not often the best offer the insurance company will make.  We will quite often negotiate further, referring to the facts and evidence in the settlement demand letter.  We may allow the insurance company to meet you in person (with us by your side).  This is another place where our expertise in negotiating these claims can bring additional value to you.   Again, the focus is always maximizing your recovery for your benefit.  You will know at every dollar amount offered by the insurance company, how much money you will receive.  In this way you can make a fully informed decision about whether to accept the offer or not.  Let us help you maximize your personal injury recovery. Litigation:
